General Terms and Conditions
These General Terms and Conditions ("Terms") govern the rights and obligations between you as the Buyer and us, Femvie s.r.o., as the Seller of goods offered on our online store at http://www.femvie.com.
When selling goods and providing other services, personal data may also be processed. For this, we have prepared a separate document titled Privacy Policy, available at https://femvie.com/policies/privacy-policy.
As you know, we communicate primarily remotely. Therefore, our Contract is concluded using remote communication means, allowing us to agree without being physically present together.
If any part of these Terms conflicts with what we have specifically agreed during your purchase on our e-shop, the specific agreement will take precedence.
Definitions
1.1 Price is the amount you will pay for the Goods.
1.2 Shipping Price is the amount you will pay for delivery, including packaging.
1.3 Total Price is the sum of the Price and Shipping Price.
1.4 VAT means value-added tax as per applicable laws.
1.5 E-shop is our online store at http://www.femvie.com where you can purchase Goods.
1.6 Invoice is a tax document issued according to VAT laws for the Total Price.
1.7 We/Us means Femvie s.r.o., registered office: Za Štěpnicí 374, 252 03 Řitka, ID: 08949743, registered at the Municipal Court in Prague, file no. C 328046, email hello@femvie.com, phone +420 721 504 020, referred to as the Seller.
1.8 Order means your binding order and conclusion of a Purchase Contract with us.
1.9 Contract means the purchase contract concluded upon sending a properly filled Order through the E-shop, effective upon order submission.
1.10 Subscription means the regular delivery of Goods under Article 10 of these Terms.
1.11 User Account is an account set up using your data, allowing you to save details and track order and contract history.
1.12 You means the person purchasing through our E-shop, referred to as the Buyer.
1.13 Goods means all items available for purchase on the E-shop.
1.14 Program refers to individual coaching and consultation programs or group coaching programs.
General Provisions and Instructions
2.1 Goods may only be purchased through the E-shop interface.
2.2 You are obliged to provide all information correctly and truthfully. We will consider the information provided in the Order as accurate and true.
2.3 These Terms do not apply if you purchase as a legal entity or as an entrepreneur. In such cases, a separate agreement will be made.
2.4 The Seller may amend these Terms. Any changes will not affect relationships established under previous versions.
2.5 The Seller is not a VAT payer; prices do not include VAT. Prices remain valid as displayed in the Store.
2.6 Delivery costs vary depending on delivery and payment methods chosen. Delivery costs are not included in the agreed Price unless specified otherwise. You bear any fees for third-party payment services related to paying the agreed Price.
Conclusion of Contract
3.1 Contracts can only be concluded in Czech.
3.2 The Contract is concluded remotely via the E-shop. You bear the cost of using remote communication means, which do not differ from your standard internet costs. By placing an Order, you agree to this method.
3.3 To conclude a Contract, you must create an Order in the E-shop, providing:

Information about the Goods (selected via “Add to cart”).

Price, Shipping Price, payment method, and delivery method; these will be automatically displayed.

Your identification and delivery details (name, surname, delivery address, phone number, email).

For Subscriptions, information on how long deliveries should continue.
3.4 You can modify data during the Order creation. By clicking “Order with obligation to pay,” you submit the Order. Before clicking, you must confirm your knowledge and agreement with these Terms via a checkbox. The Contract is concluded when you click “Order with obligation to pay.”
3.5 We will confirm receipt of your Order via email, including a summary and these Terms, which form an integral part of the Contract.
3.6 We may not always be able to confirm your Order, for example, if Goods are unavailable or if you exceed purchase limits. We will inform you and offer a new Contract. The new Contract is concluded upon your acceptance and replaces the original. If no agreement is reached, either party may withdraw.
3.7 If a clearly incorrect Price is listed, we are not obliged to deliver at that Price. We will contact you with a new offer. If you do not confirm within 3 days, we may withdraw.
3.8 Upon conclusion of the Contract, you are obliged to pay the Total Price.
3.9 If you have a User Account, you may order through it but must verify the accuracy of pre-filled data. You must have a User Account for Subscriptions.
3.10 Discounts can only be used if entered in the Order. Discounts cannot be combined and do not apply to gift vouchers.
User Account
4.1 You can access your User Account upon registration. You do not need an account for one-time purchases, but it is required for Subscriptions.
4.2 You must enter accurate data and update it as needed.
4.3 Access is secured with a username and password; you are responsible for keeping them confidential.
4.4 The account is personal and may not be shared.
4.5 We may cancel your account if you breach the Contract.
4.6 Availability may be temporarily interrupted for maintenance.
4.7 You can request account deletion via hello@femvie.com. We cannot delete accounts with active Subscriptions.
Price and Payment Terms, Retention of Title
5.1 Prices are stated on the E-shop, in the Order, and the Contract. In case of discrepancies, the Order price prevails.
5.2 We are not VAT payers.
5.3 The Total Price must be paid before delivery:
a) Bank transfer (details provided in the confirmation, payable within 10 days). Bank transfer cannot be used for Subscriptions.
b) Online card payment via Stripe.
5.4 Invoices will be emailed electronically after payment.
5.5 Ownership transfers upon full payment and receipt.
5.6 Gifts provided with Goods are subject to a conditional donation agreement and must be returned if the Contract is terminated.

Delivery, Risk of Damage
6.1 Goods are delivered via the chosen method (e.g., Zásilkovna pickup).
6.2 Delivery is limited to CZ and Slovakia.
6.3 Delivery time depends on availability and method chosen.
6.4 You must check package integrity upon receipt and report issues immediately.
6.5 If damage is found after receipt, email photos within 48 hours to hello@femvie.com with your Order number.
6.6 Refusal to accept Goods does not void your obligation to pay.
6.7 If re-delivery is needed due to your actions, you must cover costs.
6.8 Risk transfers to you upon receipt or when you had the opportunity to receive it but didn’t.
6.9 If Goods are not available within 30 days, either party may withdraw.
Rights from Defective Performance
7.1 We guarantee Goods are defect-free upon risk transfer.
7.2 In case of defects, you may claim via email or mail.
7.3 For material breaches, you can request new Goods, repair, discount, or withdraw.
7.4 For non-material breaches, you can request repair, replacement, or discount.
7.5 If defects persist, you may withdraw.
7.6 You cannot withdraw or request new Goods if unable to return them in original condition unless certain exceptions apply.
7.7 We will confirm claim receipt within 3 days and resolve it within 30 days.
7.8 We will notify you by email. If justified, you may be reimbursed for necessary costs.
7.9 Defect claims are governed by the Civil Code and Consumer Protection Act.
7.10 Businesses must report defects without undue delay, within 3 days.
7.11 Consumers may claim within 24 months.
7.12 Defect claims do not apply to discounted items with known defects, normal wear, or used Goods matching prior condition.
Withdrawal from the Contract
8.1 You may withdraw under specified conditions.
8.2 Consumers may withdraw without reason within 14 days.
8.3 You cannot withdraw for customized, perishable, mixed, or unsealed hygiene Goods, or digital content delivered with your consent.
8.4 The period is met if notice is sent before it expires.
8.5 Refunds within 14 days, not before Goods are returned.
8.6 You must return Goods within 14 days and cover return costs.
8.7 You are liable for any damage beyond necessary handling.
8.8 We may withdraw if delivery is impossible or if false information was given.
Consumer Dispute Resolution
9.1 Consumers can contact the Czech Trade Inspection for ADR.
9.2 You may also use the ODR platform at ec.europa.eu/consumers/odr/.
9.3 Contact for ODR: European Consumer Centre Czech Republic.
Subscription
10.1 You may also order a Subscription via the E-shop.
10.2 Subscription details: https://femvie.com/products/tampon-subscription.
10.3 Manage it via "My Account."
10.4 Only payable by card via Stripe.
10.5 Goods are shipped within 2 days of email notification.
10.6 Cancel at least 1 day before the next shipment.
Webinars
11.1 You may also order webinars via the E-shop.

11.3 These Terms govern the relationship.
11.4 The contract is concluded upon payment.
11.5 We guarantee participation upon payment.
11.6 The user agrees to pay, follow instructions, and act per these Terms.
Coaching Programs
12.1 You may also order coaching via the E-shop.

12.3 Registration confirms no barriers to participation.
12.4 Registration requires data entry and agreement to Terms.
12.5 By registering, you declare full legal capacity, truthful data, and acceptance of Terms.
12.6 Payment confirms registration.
12.7 No refunds for non-participation.
12.8 You agree to confidentiality and non-sharing of materials.
Final Provisions
13.1 Czech law governs, even if there’s an international element.
13.2 Communication will be via email.
13.3 The Terms may change; new Terms apply only to future Contracts.
13.4 We are not subject to any codes of conduct.
13.5 These Terms are effective from May 3, 2021.
